You can read my new post on the subject over at China Law Blog. The post is in response to recent pro-gay marriage rulings in the US and the question, Can that ever happen in China?

I would be giving China a lot of Koala Stamps if it legalised gay marriage sooner rather than later.
The US (13 states actually) shouldn’t go into congratulations mode, as it was well and truly preceded by Mexico (RC: love a duck) and NZ.
Such is big city anomie combined with rapid/brutal demographic changes in China today, that the old attachment to the Confucian family tree could end up as little more than a popular memory within decades.
Sexual politics is probably the only domain in contemporary China that offers a degree of optimism.
No Christianity, and therefore no concept of shame, sin or sexual guilt.
And this is despite the million or so news articles about how the marriage market operates in China today.

The issue is more that no one in the Chinese government wants to spend political capital upending the status quo, rather than any sort of bias against homosexuality.
China needs a gay rights movement that knows how to lobby, China-style – then, given the lack of bias in society writ large, a policy shift should be relatively straightforward.

@ t_co. So we sort of agree.
And I have yet to advance my arguments for my #1.

I doubt China will legalize gay marriage in the foreseeable future, which is unfortunate because I feel Chinese society as a whole is FAR more tolerant of homosexuality and the concept of gay marriage than America.
